Which Certificate Do You Need Before You Sell?

Property Acquired Before 1 April 2001

For a property acquired before 1 April 2001, a Section 55(2)(b) FMV Certificate as on 1 April 2001 can be an important document in determining the applicable cost basis for capital-gain computation.

Purpose Establish the relevant 1 April 2001 FMV.
JDA / SECTION 45(5A)

JDA (Joint Development Agreement) Sale

A JDA transaction can involve a specific valuation date and statutory framework. A Section 45(5A) FMV Certificate may be required for determining the relevant fair market value in the applicable circumstances.

A DSV / FSV Certificate can document market value and distressed sale value where required for enforcement and reserve-price considerations.

02 IBC / CIRP

IBC CIRP Property

An IBBI Valuation Report may determine Fair Value and Liquidation Value under the applicable IBBI framework through a registered valuer in the relevant asset class.

03 INSURANCE

Insurance

A Replacement Cost Certificate can establish replacement cost / RCN for the building component. Land value is generally excluded from building replacement-cost insurance assessment.

Fair Rent Determination

A Fair Rent Certificate can establish market rent using relevant rental comparables and property-specific evidence.

NRI Selling Property in India: Which Certificate Comes First?

NRI property sales can involve valuation, capital-gain computation, TDS and lower-deduction documentation.

SECTION 55(2)(b) + SECTION 195

NRI Selling Property in India

For an NRI seller, a Section 55(2)(b) certificate can support the applicable historical FMV where the property qualifies as pre-1 April 2001 property. The relevant Section 195 TDS position also needs to be addressed as part of the transaction.
